1. Acceptance of these terms

These Terms of Service (“Terms”) govern your use of Puncto and this website, both provided by Wartle (“we,” “us,” or “our”). By downloading, accessing, or using Puncto, you agree to these Terms. If you do not agree, do not use Puncto.

2. The service

Puncto is a personal productivity tool for tracking punctuality routines and streaks. It may offer optional features such as location-based arrival verification, reminders, widgets, profile photos, and Puncto Pro subscriptions.

Puncto is not an attendance system, timekeeping system, safety service, emergency service, navigation service, or proof of presence for an employer, school, government agency, or any other third party. You are responsible for deciding whether Puncto is appropriate for your needs.

3. Location and safety

Location estimates can be inaccurate, incomplete, delayed, or unavailable. Do not rely on Puncto’s location features for safety-critical, emergency, navigation, legal, payroll, employment, academic, or compliance decisions.

Use Puncto responsibly. Do not interact with the app while driving or when doing so would distract you from your surroundings. Always follow applicable laws and rules.

4. Puncto Pro and payments

Some features may be offered through an optional Puncto Pro subscription. Purchases are billed through Apple’s App Store or Google Play, subject to the applicable store’s terms, payment methods, and refund policies.

Subscriptions may renew automatically unless you cancel them through your app-store account before the renewal date. You can manage or cancel a subscription through the subscription settings of the store used to purchase it. We do not control app-store billing, refunds, or payment processing.

5. Acceptable use

You may use Puncto only for lawful personal use and in accordance with these Terms. You may not:

  • reverse engineer, decompile, modify, or attempt to extract the source code of Puncto except where law permits it;
  • use Puncto to violate another person’s privacy, rights, or applicable law;
  • interfere with Puncto, its purchase services, or related systems; or
  • misrepresent Puncto check-ins or output as an official record or third-party certification.

6. Disclaimers

Puncto is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, and uninterrupted operation.

We do not guarantee that Puncto will be error-free, that location verification will be accurate, or that reminders will always be delivered at a particular time.

7. Limitation of liability

To the maximum extent permitted by applicable law, Wartle and its affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or business opportunity arising from or related to your use of Puncto.

To the maximum extent permitted by law, our total liability for any claim relating to Puncto will not exceed the amount you paid us for Puncto in the 12 months before the event giving rise to the claim, or USD $10 if you paid nothing.

8. Changes and termination

We may modify, suspend, or discontinue Puncto or these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Your continued use after an update means you accept the updated Terms.

You may stop using Puncto at any time. We may suspend or terminate access to paid features where reasonably necessary to protect the service, comply with law, or address misuse.
